1. Acceptance of Terms

By accessing or using HandyPunk Studio ("the Service"), including any subdomain (beta.handypunk.net, pro.handypunk.net, studio.handypunk.net), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

HandyPunk Studio is a software interface and peer-to-peer communication tool that enables users to remotely control compatible Handy devices via the Handy API. The Service provides:

• Real-time device control via WebRTC peer-to-peer data channels
• Timer and session management tools
• Optional audio/video communication between connected peers
• Configuration interfaces for tip menus and session mechanics

HandyPunk does not process payments. All financial transactions between users occur through external third-party platforms (e.g., CashApp, Venmo, Wishtender) chosen and configured by the user. HandyPunk has no visibility into, control over, or liability for these transactions.

3. Eligibility

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into this agreement.

4. User Conduct

You agree to:

• Use the Service only for lawful purposes and in compliance with all applicable laws
• Obtain proper consent from all parties before initiating device control or media sharing
• Not attempt to circumvent access controls, feature gates, or subscription tiers
• Not use the Service to harass, abuse, or harm others
• Not reverse-engineer, decompile, or create derivative works of the Service

5. Device Safety & Physical Risk

USE AT YOUR OWN RISK. HandyPunk provides a software control interface for third-party hardware devices. You acknowledge that:

• Physical devices carry inherent risks of discomfort or injury
• The Emergency Stop button is provided as a safety mechanism and should always be accessible
• You are solely responsible for ensuring safe use of any connected hardware
• HandyPunk accepts no liability for physical injury, discomfort, or property damage resulting from device use
• Connection interruptions may occur due to network conditions — users should never rely solely on remote control for safety-critical scenarios

6. Subscriptions & Payments

Certain features of the Service require a paid subscription (Pro, Studio, Studio+). Subscriptions are processed through third-party platforms (e.g., Patreon, Whop, Gumroad). HandyPunk does not directly process credit card or payment information. Refund policies are governed by the respective payment platform's terms.

7. Intellectual Property

All code, design, UI/UX patterns, and branding of HandyPunk Studio are the intellectual property of the Service owner. Users retain ownership of any content they create or transmit through the Service (e.g., chat messages, video feeds).

8. Content & Adult Material

HandyPunk does not host, store, or distribute adult content. Any audio, video, or text exchanged between peers is transmitted directly via encrypted WebRTC connections and is never stored on HandyPunk servers. Users are solely responsible for the content they share through the Service.

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, HANDYPUNK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

10. Termination

HandyPunk reserves the right to terminate or suspend your access to the Service at any time, with or without cause, and with or without notice.

11. Modifications

HandyPunk reserves the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms. Material changes will be communicated via the Service interface.

12. DMCA & Content Takedown

HandyPunk maintains a DMCA takedown process in compliance with 17 U.S.C. § 512. Reports of intellectual property infringement, abusive content, or trademark violations should be directed to legal@handypunk.net. HandyPunk reserves the right to terminate accounts that repeatedly violate these terms.

1. Information We Collect

We collect minimal data. HandyPunk is designed as a peer-to-peer application with no central user database (for free and beta tiers).

• No account required — Free and beta tiers operate without user accounts or login
• No personal data stored on our servers — All settings and preferences are stored in your browser's localStorage on your own device
• No payment data — HandyPunk never sees, processes, or stores credit card numbers or payment information
• Beta access codes — When you claim a beta code, the code identifier is stored on a Cloudflare Worker KV store to prevent reuse. No personal information is attached to this record.
• Feedback submissions — If you voluntarily submit feedback via the in-app form, your message (and optional email, if provided) is sent to Formspree. We use this solely to improve the Service.
• Email (optional) — If you provide your email via our contact form, it is used only for critical service communications (e.g., payment processor migration). We will never sell or share your email.

2. Peer-to-Peer Communication

Audio, video, text chat, and device control commands are transmitted directly between peers via encrypted WebRTC connections. This data:

• Is not routed through HandyPunk servers (except for initial WebRTC signaling via PeerJS)
• Is not recorded, stored, or logged by HandyPunk
• Is end-to-end encrypted by the WebRTC protocol (DTLS-SRTP)

The PeerJS signaling server (used only for initial connection handshake) does not have access to the content of your data channel messages or media streams.

3. Handy Device API

When you connect a Handy device, your connection key is used to communicate with the Handy API (handyfeeling.com). This key is:

• Stored in your browser's localStorage on your device
• Transmitted to the Handy API servers for device control
• In the Hybrid Fleet mode, optionally shared with the connected pilot via P2P for direct device control (with your explicit consent)
• Never stored on HandyPunk servers

4. Cookies & Local Storage

HandyPunk uses browser localStorage (not cookies) to persist:

• Device connection keys
• Session preferences (tip menu config, challenge settings, etc.)
• Beta gate activation timestamps
• Tutorial dismissal timestamps
• Error logs (stored locally for debugging, never transmitted automatically)

No tracking cookies are used. No third-party advertising trackers are present.

5. Analytics

HandyPunk collects anonymous usage analytics (session duration, feature usage, connection events) for product improvement. No personally identifiable information is collected or stored. Analytics events are transmitted via navigator.sendBeacon or fetch to a Cloudflare Worker endpoint. Each page load generates a random session UUID that is not linked to any user identity and is discarded when the browser tab is closed.

6. Third-Party Services

The Service integrates with:

• PeerJS — WebRTC signaling (peerjs.com)
• Handy API — Device control (handyfeeling.com)
• Formspree — Feedback collection (formspree.io)
• Cloudflare Workers — Beta code validation
• Tailwind CSS CDN — Styling
• Google Fonts — Typography

Each third-party service operates under its own privacy policy. HandyPunk is not responsible for the data practices of third-party services.

7. Data Retention

Since user data is stored in browser localStorage, you control your own data. You can clear all HandyPunk data at any time by:

• Using the "Factory Reset" feature in the app (clears lifetime stats)
• Clearing your browser's site data for the HandyPunk domain

Beta code claim records on Cloudflare Workers KV are retained for the duration of the beta program.

8. Children's Privacy

The Service is strictly for users aged 18 and older. We do not knowingly collect data from anyone under 18. If we become aware that a minor has used the Service, we will take steps to remove any associated data.

9. Changes to This Policy

We may update this Privacy Policy from time to time. Changes will be posted on this page with an updated "Last Updated" date.
